Terms & Conditions

1. Agreement

These Terms & Conditions ("Terms") govern your access to and use of KalmForge ("Service"), provided by KalmForge ("we", "us"). By creating an account or using the Service you agree to these Terms. If you are using KalmForge on behalf of an organization, you represent that you have authority to bind that organization.

2. Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use. You must be at least 16 years old to use the Service.

3. Subscriptions & billing

  • Paid plans renew automatically until cancelled. Fees are charged in advance and are non-refundable except where required by law.
  • You may cancel at any time from your billing settings; cancellation takes effect at the end of the current period.
  • We may change pricing with reasonable advance notice; changes apply to the next renewal cycle.

4. Acceptable use

You agree not to:

  • Violate any law or third-party right.
  • Upload malware, attempt to bypass security, or disrupt the Service.
  • Reverse engineer the Service except as permitted by law.
  • Use the Service to store or transmit content that is illegal, infringing, or harmful.

5. Fair use policy

Plan limits ensure consistent performance for every studio. The following ceilings apply per project per calendar month, measured by our metering pipeline. Occasional brief spikes are tolerated; sustained overages may be throttled, billed as overage, or require a plan upgrade.

5.2 Rate limits

  • SDK ingest endpoints (analytics, logs, sessions): up to 5,000 requests / minute / project on Indie, 25,000 on Studio, 100,000 on Growth.
  • Dashboard & management API: 600 requests / minute / user.
  • Partner / promo code APIs: 60 requests / minute / API key.
  • Device log batches are deduplicated and sampled server-side; identical fingerprints are aggregated to control storage cost.

5.3 What counts as abuse

  • Sharing a single project across multiple unrelated games or studios to bypass per-project quotas.
  • Generating synthetic traffic, fake players, or non-human events to inflate metrics or stress the platform.
  • Using KalmForge as a generic backend, file host, or message bus unrelated to your game's live ops.
  • Repeatedly hammering an endpoint after receiving a 429 response without exponential backoff.

5.4 What happens when you exceed limits

  1. We notify the workspace owner by email when you reach 80% and 100% of any monthly quota.
  2. Soft-cap resources (analytics, logs, fetches) continue to accept traffic but may be sampled or rate-limited.
  3. Hard-cap resources (projects, seats) are blocked from creating additional records until you upgrade.
  4. Sustained overages (3+ consecutive months above 110%) require an upgrade or will be billed at standard overage rates.
  5. Abuse, as defined in 5.3, may result in immediate throttling or suspension under our Termination clause below.

6. Your content

You retain ownership of the data, configurations, and assets you upload ("Customer Content"). You grant us a limited license to host, process, and transmit Customer Content solely to operate the Service. You are responsible for the legality of Customer Content and for having all necessary rights to it.

7. Our intellectual property

The Service, including the dashboard, SDKs, documentation, and branding, is owned by KalmForge and protected by intellectual property laws. Except for the rights expressly granted in these Terms, no rights are transferred to you.

8. Service availability, downtime and outages

The Service is provided on an "as available" basis. While we use commercially reasonable efforts to maintain high availability, we do not warrant or guarantee that the Service, the dashboard, the SDKs, the APIs, or any individual feature (including, without limitation, remote configuration, analytics, leaderboards, live events, in-game messaging, push notifications, store catalog, promo codes, AI translations, device logs, crash reporting and A/B testing) will be uninterrupted, timely, secure, error-free, or continuously reachable from your applications or your end users' devices.

You acknowledge and agree that the Service may from time to time be unavailable or degraded as a result of, without limitation: (a) scheduled or emergency maintenance; (b) updates, patches, modifications, deprecations or discontinuation of features or endpoints; (c) failures, latency or outages of upstream infrastructure, hosting, networking, DNS, content delivery networks, payment processors, email or messaging providers, app-store services, or third-party AI, analytics or push notification providers; (d) acts, omissions or configuration changes of your hosting provider, internet service provider, device operating system vendor or end users; (e) bugs, regressions or security incidents; (f) suspension or rate limiting in accordance with these Terms or applicable usage limits; or (g) events of force majeure as described below. Where reasonably practicable we will provide advance notice of planned maintenance, but we are under no obligation to do so for emergency or third-party-driven events.

You are solely responsible for designing, building and operating your applications so that they degrade gracefully in the event the Service, any feature, or any data returned by the Service is unavailable, delayed, partial, stale or unreachable. This includes, without limitation, implementing reasonable caching, local fallback values, default configurations, retries with backoff, offline modes, error handling, and user-facing messaging within your applications. You acknowledge that the Service is not intended for use in any environment where failure or interruption could result in death, personal injury, or environmental, financial or property damage, and you agree not to deploy the Service in such environments.

To the maximum extent permitted by applicable law, and except where any service-level commitment has been expressly agreed with you in a separate written agreement signed by an authorised representative of KalmForge, we make no service-level commitment of any kind. We will have no liability whatsoever to you, to your end users, players, customers, licensees or any other third party for any loss, damage, cost, expense, claim, demand, chargeback, refund, lost revenue, lost profits, lost goodwill, lost data, reputational harm, regulatory penalty or other consequence of any kind arising out of or in connection with any unavailability, downtime, outage, interruption, latency, degradation, error, data loss, data corruption, or loss of connectivity between any application, device, server or end user and the Service or any feature of it. You agree to defend, indemnify and hold harmless KalmForge and its officers, directors, employees, contractors and agents from and against any and all such third-party claims, including reasonable legal fees, brought by your end users or other third parties relating to any such unavailability, outage or loss of connectivity.

Neither party will be liable for any failure or delay in performance to the extent caused by events beyond its reasonable control, including without limitation acts of God, natural disasters, war, terrorism, civil unrest, labour disputes, governmental action, changes in law, pandemic or epidemic, cyber-attack, denial-of-service attack, internet or telecommunications failure, power failure, or failure or outage of any third-party service, platform or infrastructure on which the Service depends.

Any remedies expressly set out in these Terms in respect of unavailability or outages are your sole and exclusive remedy. The limitations and exclusions in this section apply in addition to, and do not limit, the disclaimers in Section 10 (Disclaimers) and the limitation of liability in Section 11 (Limitation of liability).

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to us or other users. Upon termination, your right to use the Service ceases; certain provisions survive.

10. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

11. Limitation of liability

To the fullest extent permitted by law, KalmForge will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.

12. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated via the dashboard or email. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which KalmForge is established, without regard to conflict of laws principles.
